Terms of Service and Conditions
Master Service Agreement (MSA)
This English translation is provided for convenience only. In case of any discrepancy, the Thai version shall prevail. For the legally binding original document, please refer to the Thai version (ภาษาไทย).

2.Acceptance of Terms
By registering for, paying for, or beginning to use any Service of the Provider, the User is deemed to have read, understood, and accepted all terms of this Agreement completely and unconditionally. The User represents that they are at least 18 years of age, or have the consent of a parent or legal guardian, and have the legal capacity to enter into contracts under Thai law.
If you do not agree to any term of this Agreement, please discontinue use of the Services immediately and contact us to request account cancellation before the start of the next billing cycle.
3.Acceptable Use Policy
Users must use the Services in good faith, in compliance with Thai law and any applicable international law, and must not cause harm to the Provider, other users, or third parties, including compliance with the following resource limits:

Usage exceeding these limits may be automatically throttled or suspended in order to maintain the stability of the overall system.
4.Strictly Prohibited Activities
- Section 112 / National Security: Publishing content that violates the Institution of the Monarchy, or that threatens national security, under Section 14 of the Computer Crime Act B.E. 2550.
- Gambling: Creating, hosting, or promoting gambling websites, gambling redirect systems, gambling top-up systems, or any advertising material related to gambling in any form.
- Pornographic Content: Storing or distributing pornographic material, especially content involving minors, which constitutes a serious criminal offense.
- System Attacks: DDoS, port scanning, brute force, SQL injection, XSS, or any act intended to destroy, disrupt, or gain unauthorized access to a system.
- Spam / Phishing: Sending bulk unsolicited email, deceptive email, or any act that causes the Provider's IP addresses to be blacklisted.
- Crypto Mining: Using server resources to mine any digital currency (Bitcoin, Monero, Chia, etc.).
- BitTorrent / Seedbox: Using the Service as a seedbox, or for downloading/sharing files via P2P that continuously consumes high bandwidth.
- Copyright Infringement: Storing or distributing software, films, music, or anything that infringes copyright (DMCA/Copyright).
- Forex / EA Bot: Providing Signal, EA Bot, Copy Trade, or any service related to the Forex market without a license from the Thai SEC (ก.ล.ต.).
- Malware / Ransomware: Hosting, creating, or distributing viruses, ransomware, spyware, rootkits, trojans, or any type of malicious program intended to damage or gain unauthorized access to another party's system.
- Public VPN / Tor Exit Node: Providing a public VPN service or operating a Tor Exit Node for third parties, which serves as a channel to conceal illegal activity (use of VPN within the User's own organization is permitted).
- Game Bots / Black Hat SEO: Using server resources to run game bots, auto-clickers, fake traffic exchanges, black hat SEO, or any activity that violates the terms of service of the target platform.
Upon detection of any of the above activities, the Provider will: (1) suspend the Service immediately without prior notice; (2) not refund any remaining Service fees under any circumstances; and (3) collect log files, IP addresses, and all evidence to be submitted to the police and relevant authorities for prosecution to the fullest extent of the law.
5.Account Responsibility & Security
Users must provide accurate, complete, and up-to-date information when registering, and must update such information immediately upon any change.
- Password Security: The User is fully responsible for maintaining the confidentiality of their password and for controlling access to their own account. All activity under the account is the responsibility of the account holder, regardless of whether it was carried out by the account holder or another person.
- Reporting Incidents: If the User discovers or suspects unauthorized access to their account, they must notify the Provider immediately via [email protected]. Delayed reporting may result in the loss of the right to claim for damages that occurred prior to such notification.
- Account Transfer: Transferring, selling, or allowing another person to use one's account without prior written permission is prohibited.
- Reseller Accounts: Users who resell the Service (Resellers) are responsible for the actions of their own customers as if such actions were their own.
6.Payment & Chargeback Policy
All Service fees are payable in Thai Baht (THB) through the channels specified on billing.in.th. Users must pay on or before the due date. Services that are not renewed may be automatically suspended.
Filing a chargeback (payment dispute) with a bank or credit card provider without first going through the refund process under this Agreement constitutes a serious breach of contract, and will result in: (1) immediate closure of all services and accounts; (2) recovery of any fees actually charged to the Provider by the bank or payment processor for each such instance; and (3) civil legal action to claim damages, including attorney's fees.

Send an email to [email protected] within the specified period, stating the Invoice Number and the reason for the request. The Provider will process the refund within 7 business days. This policy does not affect the User's statutory rights under the Consumer Protection Act B.E. 2522.
8.Suspension & Termination

The Provider has the right to suspend or terminate the Service immediately upon detecting a violation of these Terms, or where there is reasonable cause to believe that continuing to provide the Service would cause damage to the Provider or a third party.

10.Service Level (SLA) & Uptime
The Provider aims to maintain 99% Uptime per month for its core infrastructure. However, this figure is a target, not a guarantee.
- For damages arising from downtime, the Provider may compensate with additional service time (Service Credit) as determined on a case-by-case basis, with the maximum compensation not to exceed the monthly fee of the affected Service.
- The Provider is not responsible for downtime caused by: force majeure, pre-announced maintenance, actions of the User, or ISP/upstream network issues that are outside the Provider's reasonable control.
- Maintenance will be announced in advance via email or the website at least 24 hours ahead, except in emergency cases.
11.Backup & Data Policy
Every AsiaGB Hosting plan includes automated backups twice per month for the User's convenience. However, this backup is provided on a best-effort basis and does not constitute a guarantee that data can be fully recovered in every case.
Users are responsible for:
- Maintaining their own off-site backup on a regular basis, by downloading and storing data in a location outside of the Provider's system.
- Periodically verifying the integrity of their own backups.
- The Provider is not responsible for any data loss whatsoever, including database data, website files, email, and configuration settings.
12.Data After Service Termination
When a Service ends (whether by voluntary cancellation or termination by the Provider), the Provider will retain the User's data for a period of 30 days from the date of termination. The User must download all data within this period. After this period, all data will be permanently deleted from the system and cannot be recovered.
Where an account is closed due to a policy violation (Clause 4), the Provider has the right to delete data immediately without any grace period, and may retain log files for legal purposes for the period required by law.
13.Personal Data & PDPA Compliance
The Provider complies with the Personal Data Protection Act B.E. 2562 (PDPA) and the Computer Crime Act B.E. 2550 (and its amendments).
- Personal information (name, address, email, phone number) — for identity verification and service provision.
- Payment information — for processing transactions and issuing receipts (credit card data is not stored directly).
- Log Files (IP, Timestamp, Traffic) — retained pursuant to Section 26 of the Computer Crime Act, for a minimum of 90 days and a maximum of 2 years.
Users have the right to request access to, request a copy of, correct, delete, object to, transfer, or withdraw consent for their personal data by contacting [email protected] (Data Protection Officer, DPO). The Provider will process such requests within 30 days, unless the law requires such data to be retained.
The Provider will not disclose personal data to third parties, except where: (1) consent has been obtained from the User; (2) there is a court order or an order from an authorized officer under the law; or (3) it is necessary to protect the rights of the Provider or another person.
14.Limitation of Liability
Under no circumstances shall the Provider's total aggregate liability to the User for any damages, losses, or claims (whether in contract, tort, or any other theory) exceed the amount of fees actually paid by the User for the affected Service during the most recent billing cycle.
The Provider is not liable for any indirect damages, consequential damages, damages from loss of revenue, damage to reputation, or any special damages whatsoever, even if the Provider has been advised of the possibility of such damages. All Services are provided "AS IS", without any warranty, whether express or implied.
The limitation period for any claim arising from this Agreement shall be governed by the Civil and Commercial Code and other applicable Thai law.
15.Indemnification
The User agrees to defend, indemnify, and hold the Provider, its directors, employees, and affiliated companies harmless from any claims, attorney's fees, penalties, and damages arising from: (1) the User's use of the Service; (2) breach of this Agreement; (3) Content published by the User; or (4) infringement of the rights of a third party.
16.Intellectual Property
Trademarks, trade names, logos, and other intellectual property of Injan Network, AsiaGB.com, and Billing.in.th are the property of the Provider. They may not be used, reproduced, or modified without prior written permission.
The User retains ownership of the Content they create, but grants the Provider a non-exclusive license to use such Content solely for the purpose of providing the Service. The User represents that the Content they publish does not infringe upon the rights of any third party.
17.Force Majeure
The Provider is not responsible for any delay, interruption, or deficiency in the Service caused by a force majeure event that is reasonably beyond its control, including but not limited to: natural disasters, war, terrorism, riots, government orders, labor strikes, widespread power outages, telecommunications network failures, or large-scale cyberattacks that are not caused by the Provider's fault.
18.Amendments
The Provider reserves the right to amend the terms of this Agreement at any time, by notifying the User via the registered email address or through the website, at least 30 days before the effective date. Continued use of the Service after the effective date shall constitute full acceptance of the new terms. If the User does not agree, the User has the right to give notice of cancellation within the notice period given.
19.Dispute Resolution
The parties agree to first attempt to resolve any dispute arising out of or in connection with this Agreement through good-faith negotiation. If the parties are unable to reach an agreement within 30 days of the date the dispute is notified in writing, the dispute shall be submitted to the court having jurisdiction in the Kingdom of Thailand, and Thai law shall govern. This is without prejudice to consumer rights under the Consumer Case Procedure Act B.E. 2551.
20.General Provisions
- Entire Agreement: This Agreement, together with all referenced policies, constitutes the entire agreement between the parties and supersedes all prior agreements.
- Severability: If any provision is held to be void, the remaining provisions shall remain in full force and effect.
- No Waiver: The Provider's failure to enforce any right at any time shall not be deemed a waiver of that right.
- Assignment: The Provider has the right to assign this Agreement or its related rights to a successor in business without requiring the User's consent. The User does not have the right to assign this Agreement to any other party.
- Formal Notice: Formal notices shall be sent via email to [email protected] or to the address specified in the billing system, and shall be deemed received on the day following the date of sending.
- Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the Kingdom of Thailand.
